LOS ANGELES — Arguing that evidence is deteriorating, defense lawyers for the doctor charged in Michael Jackson's death are seeking urgent testing of two syringes and an IV bag found in the singer's mansion after his death.
Attorneys for Dr. Conrad Murray said during a 40-minute closed session with a judge that liquids in one of the syringes had already dried up and was now "salt," according to a transcript of the proceeding obtained Wednesday by The Associated Press.
Quantities of substances in the syringes and IV bag could be crucial to explaining how the singer died, the lawyers said at the Tuesday hearing.
Murray has pleaded not guilty to involuntary manslaughter. Authorities contend he administered a lethal dose of sedatives, including the anesthetic propofol, to Jackson in the bedroom of his rented mansion in June 2009.
Officials tested what was in the items and found traces of propofol and lidocaine, according to the transcript. But the amounts of the substances were not determined, and defense attorneys contend that may be significant in the case expected to hinge on technical and scientific data.
Superior Court Judge Michael Pastor declined to order testing on the substances Tuesday because he wanted defense attorneys to confer further with prosecutors.
The judge might order the testing late next week if the two sides can agree on how it will be conducted.
"I want to act as quickly as we can," Pastor told the attorneys.
Still, defense attorney Ed Chernoff struck an urgent tone, telling the judge, "We are doing it because the house is on fire. We need a hose."
Chernoff said substances in one broken syringe found at the mansion had dried up since June 2009, when Pastor ordered the evidence preserved. The tests sought by Murray's attorneys will destroy the samples and can only be performed once.
Prosecutor David Walgren questioned why defense attorneys had not raised the issue sooner.
"There are very technical, complex issues," he told the judge, adding he thought an agreement on the testing could eventually be reached.
Defense attorney J. Michael Flanagan told the judge his efforts to get the substances tested has been delayed because an expert in the Los Angeles County coroner's office had been on a lengthy vacation. He argued the tests should have been done after Jackson's death.
"It hasn't been done yet," Flanagan said. "It should have been done a year ago."
Tissue samples in Jackson's body were tested for levels of various substances and led to the coroner's determination that the pop singer died in part from acute propofol intoxication.
The anesthetic is supposed to be administered in hospital settings, but Murray told investigators he had been providing it to Jackson as a sleep aide and had been trying to wean him off the drug.
Chernoff has said the doctor did not give Jackson anything that should have killed him.
The tests are likely to be conducted by the coroner's office. A phone message left for coroner's Assistant Chief Ed Winter was not immediately returned.
Flanagan said the agency told him the makeup of the liquids in the syringes and IV bag were not tested because the values were not necessary to establish the cause of Jackson's death.
Flanagan said in the closed session that the results of the tests "would be very helpful information perhaps for both sides."
Chernoff told the judge results of the testing, which could take a month or more to complete, would not be used during a preliminary hearing scheduled to begin Jan. 4.
Prosecutors will lay out some of their evidence during the hearing, and Pastor will then decide whether there is enough evidence to order Murray to stand trial.
Stan Goldman said it was too early to know how the issue might impact Murray's case, but it probably gives his defense team an issue to try to create doubt in jurors' minds.
"It depends on the jury," he said. "You've suddenly gleaned a point that cannot be underestimated."
He said there didn't immediately appear to be any indication of impropriety with the evidence or testing.
But a jury possibly leaning toward acquitting Murray might be swayed by a defense argument that the evidence was either damaged or unavailable.
"It's gives them some arguments they didn't have before," Goldman said, adding he made similar arguments when he was a public defender. "Sometimes that's all you need."
First, really interesting fact...there´s a transcript from the hearing, so far, so good, and just the Associated Press obtained a copy???
Let´s analyze the article!

Of course, it always depends on the quantities of substances, that´s one of the main evidences in every death case.....Ö_ö
According to the autopsy report, there should have been an alleged "lethal dose of Propofol" in MJ´s system, findable in his heart blood, femoral blood, hospital blood ("Trauma, Gershwin"), vitreous, liver, gastric contents, urine and urine scene.
If we consider the fact, that Propofol is a very short acting anesthetic, leaving the system completely within hours, the alleged "lethal dose" must have been 10 to 20 times higher than 25 mg (2,5 ml)!!!
Beside that, the quantities of substantes in syringes and an IV bag don´t say anything, if there´s no proof, that they were used for administration!!!

Yeah, the so called 'Benzodiazepine effect'.....to get the record straight, the last time, Lorazepam should have been administered to MJ, was at 5.30 am, about 5 hours, before Propofol should have been given to MJ.
Lorazepam (2 ml, diluted!!!) would have left his system til then....and Midazolam (2 ml diluted), which should have been given at 7.30 am, about 3 hours before Propofol should have been administered.....is also a very short acting Benzodiazepine and leaves the body within 2 to 3 hours!!!
Despite that, Midazolam is usually given to patients to mitigate the dose of Propofol.
A short story from my own experience.....I had a minor surgery two weeks ago, I got 2 ml Midazolam, felt just "high" and like flying, and then, about 10 minutes later, 100 to 120 mg Propofol was administered to my body....and guess what? I´m still ALIVE!!! ;)

Okay....the judge wants the prosecutors and Murray´s legal team to find a conclusion, otherwise he might make a decision for additional testings.
Does he think, the items will get better, the longer they wait???

There´s just one question.....why wasn´t that tested before??? It´s an investitagor´s first duty to order all tests shortly after an alleged crime is committed, to prevent possible questions afterwards!!!

Michael Flanagan is absolutely correct.....and by the way, the one and only expert, who whould have been able to do the test, was on a lengthy vacation???? The Coroner´s Departement doesn´t want to tell us seriously, that there´s just ONE expert to be able to do those special tests.....do they??? ;)

Honestly, this case, the alleged "MJ murder case" won´t take place in a courtroom, because nearly everything around it happened in public as yet, and I´m quite sure, that won´t change until the trial begins.
So Murray´s legal team hopes, an indepependant jury would have as much doubts as necessary to question Dr. Murray´s guilt.....doesn´t it remind you of another trial, some years ago? ;)

Believing, that MJ is alive, is stupid???
Today I accidentally read some blogposts from a person, who presumes to be the only one, who had the "one and only" right opinion about MJ´s "death", and she thinks, all the other people around, who don´t share her opinion, are simply stupid, naive and not able to see "the truth"!
Those, who believe, that MJ is still alive, are not able to deal with reality, are not able to grieve in the right way.....just one simple question, why to grieve about a living person???
Yes, maybe I´m wrong to believe, Michael Jackson is still alive, but I´m very well able to have an open mind and an open heart to "look behind the curtain"! Call me stupid, naive or just blind, but don´t dare to judge me and those, who think different!!!
Most of the so called fans love to stress, how wonderful, loving, caring and big-hearted MJ is and how much we all could learn from him.....why didn´t you just learn the very first of all important lessons???
DON´T JUDGE!!!! Pre-justice is ignorance, one of the lessons, everyone should have learned form the horrible things, MJ went through in his life, so if you try to be "Mike-like" and try to convince others, that you are, then think first, then judge!!!
"Hoaxers", and I really dislike the word, because it´s misleading, are those, who damage the King of Pop´s memory, because they discuss their ideas and opinions??? They damage MJ´s reputation because of snooping around and in his privacy??? I´m very sure, none of us ever knew anything about MJ´s privacy, how he really behaved in private and what his thoughts are.....NONE of US!!! We see, what we should see, no more, no less!!!
And if looking deeper is a crime, then I´m guilty...because I look for facts, and just facts, I´m not interested in speculating about how emotions at the memorial are shown or not.....or if someone is smirking while talking about the "late King of Pop"...!!!
Obviously those, who believe, that MJ is still alive, are observed by the so called "non-believers", for what reason ever.....do you think, you could miss anything, huh??? Or do you need your daily dose of adrenalin to be able to get into a fuss???
You´re screaming for "justice for MJ", which means for you to see Dr. Murray behind bars, but did you ever think about the possibility, that 25 mg Propofol (2,5 ml) wouldn´t kill anybody??? And did you ever recognize, that Midazolam is a very short acting Benzodiazepine, which already left MJ´s system, before the Propofol should have been administered???
And did you consider, that the Coroner´s seal, used on the form of the Case Report, is VOID since May 25, 2004, because the shown cross was a violation of the Establishment Clause of Constitution???
That´s just some less examples of what I´m talking about...facts, and just facts!
I´m not trying to convince anybody, because I think, everyone is free to conceive their own opinion, but do me a favour and stop measering everybody by the same yardstick!!!

Sunday thoughts...
Hello, my friends,
is sunday evening, and I just watched a video, showing all the pain, MJ went through during the horrible trial in 2005. I´m honestly lost for words, seeing him....emaciated, sad, heartbroken....a broken man, lonely and abandoned!
I can´t imagine, how he dealed with that more than worse situation...did he notice on June 13, 2005, that he was aqcuitted on all counts? Is this the face of a relieved man???

It seems to me, he didn´t realize, that the horror was over....and as unbelievable as it was, the media still doubted him being really innocent....AS YET!!!
Most of his so called "friends" left him during the time, the trial went on, and decided to feed the media with lies and "private" stories about his "weird" behaviour....reckless and just focused on their own reliability and publicity!
I refuse calling names, but most of them I saw "deeply grieving" after June 25, 2009. And all of a sudden, everyone of them knew, MJ was innocent, of course!
Because one shouldn´t say anything bad about a "dead" person???
Because they could use MJ´s name again for their own publicity to show, how good friends they were???
Sorry guys, if I sound a bit angry today, but sometimes things need to be spoken out!

Lisa Marie Presley on Oprah...
I watched the interview yesterday - Lisa Marie Presley....and now I´ve to admit, it got me at some points. It wasn´t that bad I expected it to be.
I don´t want to look for possible clues, hidden in Lisa Marie´s or Oprah´s words, I don´t want to talk about the sunflowers on the table, they were sitting in front of, I just want to share my thoughts about some impressions, I got.
My very first impression was, this interview sounded pretty staged, less emotional on both sides. A "question and answer" game, very well excercised before recorded. I might be wrong, but weren´t they talking about the man, Lisa Marie called herself "to be addicted to"???
She said, she had to abandon him in 1996 although she loved him very much, and her reasons must have been very strong to make her act like that. I don´t want to judge her, everybody is responsible for their own decisions in life.
What got me, was her description of his private personality.....stubborn, childlike, focused on himself, loving, caring...and she accentuated more than one time, that they were "so united" because of their gorgeous discussions and similiar experiences in life, both were growing up in the public eyes.
She described him as "king in his own little world", who felt "godlike" in his world.....umm....just a short objection, isn´t that a completely normal behaviour for such a famous person to create a little world of privacy away from cameras and interviewers and observers???
Oprah: "Did you think, you could have saved him?" Saved him....from what? From an alleged drug abuse, which wasn´t found or confirmed during the autopsy??? From himself and his attitude on life??? From false cognates or false surrounding???
I found it a bit disturbing to hear, he shouldn´t have been able to kinda think for himself, not to be able to prevail against possible "bad people", should have been influenced all the time of his life, and I highly doubt, that this could be really true!
One word about MJ´s alleged drug abuse....he himself admitted in an interview, that he was addicted around 1992/1993, but was brought into rehab and recovered, one more addiction he admitted to have had in 2005 around the horrible child molestation trial.
Lisa Marie was asked, if she knew about MJ´s addiction and she said, she first assumed him being addicted after his breakdown in 1996 during the rehearsals for the HBO show, because the physician´s diagnoses at the hospital varied from one day to another. Altough I listened very well, I didn´t hear her saying..."yes, I saw him taking drugs"...she just spoke about doctors around him.
And I didn´t hear her saying..."I know, how he was and looked like, when he took drugs"....so, how was she able to determine, he was drugged ("speedy or sleepy") during the unpleasant Martin Bashir interview??? Because he behaved in a different way than she knew him behaving in former times, years ago???
I was stunned seeing a picture of Lisa Marie standing over MJ´s golden casket, and I asked myself, who took that photo and where was it taken?
I don´t think, someone could answer, who did take it, but as I looked closer to the pic, it seems to me, it was taken INSIDE Holly Terrace....so it must have been the time, after the casket was brought into by MJ´s brothers. Lisa Marie said, she was the last one, standing over the casket after all the others left. I wonder.....isn´t it normal, that family members are the last ones to say a last "goodbye" and receive expressions of sympathy??? Correct me, if I´m wrong!
And another detail got my attention, Elvis Presley lived in Los Angeles for some time...in Holmby Hills, right across MJ´s mansion! I searched for it on the net, and it´s correct, Elvis lived in a great mansion at Monovale Drive from 1965 to 1967, around the corner of MJ´s home.
What makes me wonder, nobody noticed that "coincidence" before??? I´ve to admit, I also didn´t know about that fact, so, where is it good for? To prove an alleged "Elvis and MJ connection"??? That both seemed to live a similiar life and died a quite similiar death???
Oh, I´m quite sure, the Mo and Souza forum might burn today because of that....LOL
To make it clear, I DON´T believe in any of that weird theories about an alleged "MJ and Elvis connection", and I never did! But it´s quite interesting, that Lisa Marie accentuated more than one time, how much she suffered from her father´s death because of drug abuse, and how she compared her father´s life and death to MJ´s. She said, she felt kinda special to have experienced something like that twice in her life, and it´s not clear for her, why she of all people is the one to get through that twice....?!?!
Oprah´s question, if Lisa would believe, that MJ´s behaviour against children, especially against little boys, was inappropriate, did sound ridiculous to me. What did she expect her to answer??? And I missed a statement from Oprah, like..." I also don´t think, he did anything wrong"....or am I expecting too much???
I´ll finish with the statement, I made in the beginning.....as for me, that interview sounded staged, arranged in any possible way and very clinical. But nevertheless, this interview didn´t damage MJ´s reputation, just my opinion.
As I posted yesterday, neither I like nor do I dislike Lisa Marie or Oprah, so thank you for the show! :)

Just to let you know....
Good morning, my friends,
one of the comments on the video, MichaelsbeLIEvers made, was the question, why they don´t send this letter to Oprah personally....and now I just want to let you know, I did send it to Oprah!
I copied the text and pasted it on Oprah´s comment section on her website. It´s still awaiting approval.....!
Today is the day, Oprah´s interview with Lisa Marie will be aired. Let´s see, what might happen and if Oprah will consider the opinion and criticism of MJ´s fans! But as far as I know, the interview was made in England, some time ago, it´s not a life interview. So, how big is the chance, that the points of criticism might have reached her right in time????
Don´t get me wrong, I´m far away from judging before I know the result!
Oprah herself didn´t have a wonderful childhood, she was the illegitimate child of minor parents. At the age of 9 she was sexual abused, got pregnant with 15, but her child died shortly after birth.
I´m quite sure, she of all people should know, what real life and false allegations mean, all the more, because she did many, many interviews with the most different people in hier long career!

Oprah herself didn´t have a wonderful childhood, she was the illegitimate child of minor parents. At the age of 9 she was sexual abused, got pregnant with 15, but her child died shortly after birth.
I´m quite sure, she of all people should know, what real life and false allegations mean, all the more, because she did many, many interviews with the most different people in hier long career!

Responses and reactions to my open letter to Oprah...
Good morning, my friends,
first of all, I thank you, MichaelsbeLIEvers, for presenting my open letter to Oprah in a great video! :)
Reading the comments I see, I´m not alone with my opinion, and now we all will see, what will happen during the unterview with Lisa Marie Presley. It will be aired tomorrow, on thursday.
Unfortunately I won´t be able to watch it in Germany, but I really hope, it will be uploaded on youtube.
There was a very short preview on American TV (thank you, my big sister for telling me!) and all I could notice was, that Oprah "trampled around" the questions..."Why did you marry him?"...."Did you suspect the drug problem?"...."Did you think, you could save him?"...."Did he have to die - for you to recognize, that he loved you?"
As far as I know, MJ and Lisa Marie got divorced on August 20, 1996, more than 14 (!) years ago....do I have to say more?
How big might be the opportunity, that Lisa Marie was involved in MJ´s personal life after that? Some visits on his last world tour in 1996/1997? Some phone calls maybe? It´s up to you to make your own conclusion....
To make it clear, neither I feel for Lisa Marie Presley nor do I dislike her, I just wonder, why she "opens her heart" right now to talk about her emotions. I hope, the upcoming interview will give some answers!

I´m not alone...

I´m a beLIEver, I´m sure, Michael Jackson is still alive and hopefully well!
I´d please you not to try to convince me, he died on June 25, 2009! And it´s not my interest to convince you, that he didn´t! I´d just please you to have an open mind to realize, that something really shady is going on in the whole "MJ case"!
All the facts, which popped up during the last 16 months after MJ´s alleged "death" led me to just one conclusion.... MJ is alive!
I´m not talking about theories, but facts, and just facts!
The Autopsy Report alone is a 'miracle' itself, and I´ll explain more about it, piece by piece by piece by piece.
My knowledge about criminal investigations is based on my profession, I practize for over 20 years.
And my only interest is to point out all those strange incoincidences to make others think more than just one time....and to show, that the media can´t be trusted in any way!
To say it with MJ´s words..."Just because it´s written, it´s not the Gospel!"

I noticed this week, you´re going to interview MJ´s ex wife, Lisa Marie Presley, about his death. Beside the fact, that I really doubt, this woman will be able to say something serious and important about that, don´t you think, it´s a bit...how to say it best....weird to make that interview in a week, you´re presenting child molestation cases???
Is it "just" coincidence or is there a deeper meaning behind? I really hope, you don´t want to cause possible coherences between your topics and Michael Jackson!
You know, Oprah, you´re something like the "First Lady" of American talkshows, you were the first one to interview and film MJ at his Neverland Ranch! He trusted you! And you should know better about the consequences of your talks and actions!
Wasn´t the media hunt for MJ in the last 20 years enough to hurt him deeply???
"Innocent until proven guilty", one of the Fundamental Rights of American History, and I don´t remember you were a real friend and defended him! Why I don´t remember anything? Because you were NOT there, neither for him nor for his family!
And after MJ was acquitted of all counts, where were you??? Good news don´t sell, right?
You should be a shining example to make it better than all the other media representatives!!! MJ deserves his name to get cleared up....in public!!!
But after I now know, you´re doing that interview at the worst of all times, I highly doubt, you mean well!
